1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of Pullster, an app provided by Steadfast Systems LLC. Pullster is a trading name of Steadfast Systems, and "Pullster" is used throughout these Terms to refer to both. By creating an account or using Pullster, you agree to these Terms. If you do not agree, please do not use the app.

2. Eligibility

You must be at least 18 years old to use Pullster. By using the app, you represent that you are 18 or older and able to enter into these Terms.

3. What Pullster Is

Pullster lets you manage your trading card collection, share posts with other collectors, and discover and coordinate trades.

3a. Free Card Information

Card images, card data, card scanning, and the catalog are free to use and are not gated behind any payment, subscription, or membership. Pullster does not charge for, meter, or paywall access to or display of card information.

4. Your Account

• You're responsible for keeping your account credentials secure and for activity that happens under your account.
• Some features (such as posting trade listings or trading by mail) may require you to verify your phone number.
• Provide accurate information and keep it up to date.

5. Your Content

You keep ownership of the photos, posts, listings, and other content you create ("Your Content"). By posting it, you grant Steadfast Systems a non-exclusive, royalty-free license to host, store, and display Your Content within the app for the purpose of operating Pullster.

You are responsible for Your Content. You represent that you have the right to post it and that it doesn't violate these Terms or any law or third-party right.

6. Acceptable Use

When using Pullster, you agree not to:

• Break the law, infringe others' rights, or facilitate fraud
• Harass, threaten, abuse, or impersonate others
• Post content that is illegal, harmful, deceptive, or that you don't have the right to share
• Attempt to scam, deceive, or take advantage of other users
• Interfere with, scrape, overload, or attempt to gain unauthorized access to the app or its systems
• Use the app to send spam or unsolicited marketing

Pullster may remove content or suspend or terminate accounts that violate these Terms.

7. Trades and Interactions Between Users

This is important, so please read it carefully.

• Pullster provides a place to discover other collectors and coordinate trades. All trades, communications, shipments, and meetings happen directly between users.
• Pullster is not a party to any trade and does not guarantee the identity, honesty, conduct, or reliability of any user, or the authenticity, condition, ownership, or value of any cards.
• Pullster does not guarantee that any trade, shipment, or meeting will happen, be completed, or turn out as expected.
• You interact and trade with other users at your own risk. You are responsible for any information or content you share or "socialize" with other users, and for evaluating the people you choose to trade with. Use common sense, especially when meeting in person or shipping cards.
• Steadfast Systems is not responsible for the conduct of any user or for how other users use information or content you choose to share.

8. Text Messages (SMS): Pullster Account Verification

Program name: Pullster Account Verification.

1. Program description. If you provide your mobile number and request phone verification, you consent to receive an account verification message by SMS from Pullster at that number. These messages contain a one-time verification link used to confirm it's you when you set up your account. This is a transactional, account-security program only. Pullster does not send marketing or promotional text messages, and Pullster does not share your mobile number with third parties for their own marketing.
2. Opting out. You can cancel the SMS service at any time. Just text "STOP" to the number the message was sent from. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to signup again you may repeat the verification process.
3. Help. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@pullster.app.
4. Carriers are not liable for delayed or undelivered messages.
5. Rates and frequency. Message and data rates may apply for any messages sent to you from us and to us from you. You will receive one message per verification request you initiate (typically only one message). If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
6. Privacy. If you have any questions regarding privacy, please read the Pullster privacy policy: Pullster Privacy Policy.

Opting out of verification messages does not delete your account, but you may not be able to complete phone verification or use features that require a verified phone number.

9. Disclaimer of Warranties

Pullster is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Pullster does not warrant that the app will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Steadfast Systems will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or relating to your use of the app or your interactions or trades with other users, including loss, damage, or non-delivery of cards, or any dispute between users. Pullster is provided free of charge, and to the fullest extent permitted by law Steadfast Systems will not be liable for any amount in connection with the app or your trades. To the extent any liability cannot be excluded under applicable law, it is limited to the minimum the law allows.

11. Indemnification

You agree to indemnify and hold harmless Steadfast Systems from any claims, damages, losses, or expenses arising out of your use of Pullster, Your Content, your interactions or trades with other users, or your violation of these Terms.

12. Termination

You can stop using Pullster and delete your account at any time. Pullster may suspend or terminate your access if you violate these Terms or to protect the app and its users.

13. Trademarks & Card Content

Pullster is an independent app by Steadfast Systems and is not affiliated with, endorsed, sponsored, or approved by Wizards of the Coast LLC. Magic: The Gathering™ and all related card names, images, and symbols are trademarks and copyrights of Wizards of the Coast LLC. Card images are sourced from Scryfall. Published cube lists shown in cube suggestions are sourced from Cube Cobra and remain the work of their authors; each suggestion links to the original cube on Cube Cobra. 14. Changes to These Terms

Pullster may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of Pullster after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Arizona, subject to the arbitration agreement below.

15a. Dispute Resolution; Arbitration

Most concerns can be resolved quickly. Please make contact first at contact@pullster.app so the issue can be resolved informally.

Except for disputes that qualify for small-claims court and except for claims to protect intellectual property, you and Steadfast Systems agree that any dispute arising out of or relating to these Terms or your use of Pullster will be resolved by binding individual arbitration, not in court, administered under the rules of a recognized arbitration provider, seated in Arizona. You and Steadfast Systems waive the right to a jury trial and agree that claims may be brought only in an individual capacity, not as part of a class or representative action.

This section does not apply to the extent prohibited by applicable law.
